"Adoption by individuals vs. couples

Most adoptions by gay people have been by individual gay men or lesbians.
Openly gay or lesbian couples frequently have been denied the opportunity to
adopt a child together because while most states officially permit single
individuals to adopt a child, they require couples to be married. Denied the
right to legal marriage, gay and lesbian couples are routinely denied the
right to adopt.

But this does not mean that gay and lesbian couples are universally blocked
from adopting a child together. Here are three ways in which gay and lesbian
couples have done so:

1.  One member of the couple petitions to adopt and after the adoption has
been processed, the other petitions for a "second-parent" adoption. Under
this arrangement, the individuals share the same legal standing as parents,
with the only difference being that there is a delay between when the first
individual and the second are legally recognized as parents. Remember,
however, that second-parent adoption is not available in all states.   To

2.  Some gay and lesbian couples have petitioned the courts to permit them to
adopt a child; and some courts have ruled that sexual orientation and marital
status are irrelevant to good parenting and granted the adoption.

3.  Finally, as a result of a class action suit the American Civil Liberties
Union filed on behalf of 200 gay and lesbian couples in New Jersey, the state
passed a policy in 1997 that allows gay and lesbian couples to adopt jointly.
This policy requires the state Division of Youth and Family Services to apply
the same standards to all prospective parents, regardless of sexual
orientation or marital status.

The bottom line

A county judge makes the ultimate decision about whether to grant an adoption
based on what he or she determines to be the "best interest" of the child,
and judges have different opinions on this score, not only from one state to
another but sometimes from one county to another (unless, as in New Jersey, a
state policy or law forbids discrimination on the basis of sexual
orientation.)

Adoption by gay and lesbian people also continues to be a politically charged
issue that is fiercely attacked by conservative groups. As a result, the law
is rapidly changing. In some states, bills are being introduced to ban
adoption by gay and lesbian people at the same time that other states are
repealing old bans."

Two German children - aged five and six - have been stopped by police from eloping to Africa to tie the knot in the sun, reports say.

The budding lovebirds, identified as Mika and Anna-Lena, packed bathing costumes, sunglasses and a lilo and headed for the airport.

They even had the presence of mind to invite along an official witness - Anna-Lena's seven-year-old sister.

The three got as far as Hanover railway station before police intervened.

The young couple were "very much in love" and had decided to get married in Africa "where it is warm", police spokesman Holger Jureczko told the AFP news agency.

Sun-seekers

The idea for the getaway wedding was born as the children's families celebrated New Year's eve together and Mika regaled the two girls with stories of a recent holiday to Italy.

The following morning, as their parents slept, the intrepid trio walked 1km (0.6 miles) to the local tram station at Langenhagen, where they hopped aboard a tram for Hanover central station.

But the group aroused the suspicion of a guard as they waited for a train to the airport, and police were called in.

Officers persuaded the children they would not get far without tickets and money, but consoled them with a free tour of the police station, where they were shortly picked up by relieved parents.

Although any marriage plans have been put on hold for now, police did not altogether rule out the possibility of an African wedding.

"They can still put their plan into action at a later date," AFP quoted the spokesman as saying.

emergency.

Evidence of life insurance policies where the spouse is named as
beneficiary.

Evidence of medical or health insurance plans, which name the spouse
as a member or beneficiary.

Evidence of correspondence between parties, including letters,
birthday and holiday cards, telephone calls, and other correspondence
addressed to the parties.

Religious marriage certificates if the couple had a church wedding.

Copies of gas, electric, telephone and other utility bills.

Evidence of joint ownership of an automobile.

Evidence of all major purchases made together, such as stereo,
television, refrigerator, washer, dryer, etc.

Pictures of spouse and family.

In paperwork filed Thursday in Los Angeles County Superior Court, Locklear requests physical custody of the couple's 8-year-old daughter, Ava Elizabeth, with visitation rights for Sambora. The actress cites "irreconcilable differences" as the reason for the split. According to the divorce petition, the couple signed a prenuptial agreement that determines how their assets will be divided.

More than an hour after Locklear's publicist spread the word that their 11-year-marriage was kaput, the Bon Jovi guitarist told ABC News Radio in an exclusive interview that things were fine at home.
"It's completely untrue," he insisted, adding that he had Valentine's Day plans with his wife.
Nevertheless, the "Spin City" actress had already set the legal wheels in motion, and her spokeswoman CeCe York was spreading the word.
"After 10 years of marriage, Heather Locklear has filed for divorce from Richie Sambora," the rep said in a statement hours earlier. "This is a private matter and there will be no further comment at this time."
The message was apparently not delivered to the rocker, who has been touring recently, and spoke with ABC shortly before a show at Washington D.C.'s MCI Center.
Even when confronted with the report, which had then hit the news wires, he spoke lovingly of Locklear.
"I'm going home," said Sambora, who says that Locklear sometimes joins him when he's touring.
"Heather was just up for our anniversary and that was December 15th … I was home for like two and a half weeks in Christmas and I have a month off in March, so it's going to be good."
'The Real Story Is That There Is No Story'
Sambora, 46 is a founding member of Bon Jovi. Locklear, his 44-year-old wife, is one of TV's most familiar faces, having gained fame in the early 1980s as sexy Sammy Jo Dean Carrington on "Dynasty." She's also been a regular on "T.J. Hooker," "Melrose Place" and "Spin City." She recently appeared in the film, "The Perfect Man."
Locklear was previously married to rock star Tommy Lee. They divorced after seven years in 1993.
Sambora and Locklear -- who have an 8-year-old daughter -- had been hounded by rumors of a breakup. After tabloid reports that they were fighting over a second child, they issued a joint statement to the New York Daily News in December, stating, "The real story is that there is no story. The truth is that after 11 years together, we are still happily married. Boring but true."
In the interview this evening, Sambora was asked if there were any more kids in his future.
"I wish," he said. "I mean it just gets to the point where women just go, 'I don't want to go through that again.' For us it's easy -- we point and shoot."
While fatherhood is demanding, Sambora said he enjoys it. "At the end of it, it's worth it, yeah, but I mean, really, it's a good two years of your life, you know, for each kid."
