problem, wydaje się, że "adresat" i "nadawca", ale nie jestem pewien



Biorąc pod uwagę treść odpowiedzi z ministerstwa, to "responding party" to
organ przyjmujący, a "initiating party" to organ wysyłający...

Spotkałem się z tym tłumacząc pisma przewodnie w sprawie roszczeń o alimenty,
w których organem przyjmującym był Urząd Lorda Kanclerza w Anglii. Te sprawy
opisane są w "New York Convention of 20 June 1956 on the Recovery Abroad of
Maintenance". KOnwencja o dochodzeniu roszczeń alimentacyjnych za granicą... A
propos - moze ktos ma jej tresc po polsku i po angielsku?

Fox’s crime drama ‶Bones” delivered solid ratings with its fourth-season premiere on Wednesday, earning 9.7 million viewers from 8 to 10 p.m., according to Nielsen’s estimates. It was the show’s best season debut since its first episode, in 2005. Fox led the night over all, just ahead of NBC, which garnered 10.2 million viewers from 8 to 10 with ‶America’s Got Talent” but had its average dragged down by its 10 o’clock coverage of the Republican National Convention. Ratings for coverage of the convention, which included speeches by Gov. Sarah Palin and Rudolph W. Giuliani, were not immediately available, but preliminary estimates show that NBC won the hour among the three major networks, with ABC in second and CBS in third. The total audience for the night’s coverage, including both cable and network broadcasts, appeared to be significantly higher than Tuesday’s 21.5 million, which fell 600,000 short of the second night of the Republican convention four years ago. With mostly repeats on Wednesday, CBS ranked third and ABC fourth for the night, although CW beat both networks among adults 18 to 49, thanks to the premiere of the 11th edition of ‶America’s Next Top Model,” which drew 3.5 million total viewers from 8 to 10.

"I must respectfully object to having my music misappropriated for a political campaign that I do not personally support," David Coverdale said in an e-mail statement to RAW STORY, after hearing the song at a McCain rally broadcast on CNN. "I am delighted to add that this election is my first voting experience as a brand new citizen of the United States of America... I voted for, & fully support, the Democratic representative, Senator Barak Obama, & believe in my heart & soul that he will best represent these United States in the most profound & fulfilling way."

Coverdale, a UK native, became an American citizen in March of 2007 after living in the US for 20 years.

The Whitesnake founder and lead singer joins a growing list of songwriters and entertainers dismayed at McCain's misappropriation of their material. Others who have objected include Van Halen, the Foo Fighters, Jackson Browne, Frankie Valli, Jon Bon Jovi and John Mellencamp.

After the Republican National Convention, Heart asked the campaign to stop using its song, "Barracuda" to introduce VP nominee Sarah Palin. John Hall, the founding member of Orleans, asked McCain to stop using his song "Still the One"; Hall is now a Democratic congressman from New York.

Earlier this year, McCain said he would not play "Take a Chance on Me" by Swedish pop group Abba, one of the GOP nominee's favorites, because of concerns over expensive copyright fees.

MOTLEY CRUE EXTENDS TOUR INTO 2006:

NEW YORK (Billboard) - Having racked up an improbably successful reunion tour this year, Motley Crue is heading back on the road in 2006.

The hard rock quartet will close out the year with a December 31 New Year's Eve show in Auburn Hills, Mich., and then resume touring February 10 in Columbus, Ga.

The trek will focus on secondary markets such as Evansville, Ind., Roanoke, Va., and Sioux Falls, S.D., where it will wrap up on April 1. It will also visit Lincoln, Neb., on March 31, where drummer Tommy Lee filmed his recent reality series, "Tommy Lee Goes to College."

Afterward, Motley Crue plans to begin work on its first new studio album since 2000's "New Tattoo." A handful of new songs were included on the compilation "Red, White & Crue," which debuted in February at No. 6 on the Billboard 200.

The band's 2005 roadwork has grossed more than $33 million from 84 shows reported to Billboard Boxscore, 40 of them sell-outs. Saturday (November 19), Motley Crue begins a swing through Japan and Australia that also includes a December 14 show in Honolulu.

If you were going to respond to my request for a stricter steroid policy in boxing -- random testing -- you should have at least told the world the real "TRUTH".....You are a liar AND a cheat! As my team has pointed out in the past, the reason you did not appeal the sanctions the New York State Athletic Commission and the WBA imposed for violating their rules is simple: You were caught using performance enhancing anabolic steroids. Even when we dared you to appeal, you refused. Why? The reason is your excuse about prescription drugs magically turning into an anabolic steroid is an outright lie and medically impossible. The NYSAC already rejected that so-called excuse and if you had appealed, you would have had to release any confidentiality regarding the actual results of your doping test. If that were done your lies would be obvious to everyone. Your blood was full of nandrolone, a performance enhancing anabolic steroid. The nonsense you claim about speeding cars and "extenuating circumstances" surrounding your failed test is ridiculous Talk about being a man, my challenge to you is to publicly release your blood test results. You did not do that in the past and I seriously doubt that you'll do it now. In your last sentence you applaud the Commissions and the organizations for "the great job of protecting and when need be, penalizing the fighters." Does that mean you are not going to try to have the WBA change its current rules to help you out and remove the two-year ban from the WBA ratings penalty its current anti-doping rules require? I don't think so. By the way, show some balls and let whomever you get to argue that point at the WBA convention next week in Seoul to bring a copy of your actual blood tests with them. I dare you.

  Feds want power to cancel or reschedule elections
WASHINGTON — Counterterrorism officials are looking into the possibility of postponing the November presidential election if there is a terrorist attack at election time, Newsweek reported Sunday.

Homeland Security Secretary Tom Ridge warned last week that Osama bin Laden's al-Qaeda network may attack within the USA to try to disrupt the election.

The magazine cited unnamed sources who said the Department of Homeland Security asked the Justice Department for advice last week.

Newsweek said DeForest Soaries, chairman of the U.S. Election Assistance Commission, wants Ridge to ask Congress to pass legislation giving the government power to cancel or reschedule a federal election. Soaries said New York suspended primary elections on the day of the Sept. 11 attacks, but the federal government does not appear to have that authority.

The disclosure comes only a few days after U.S. authorities said they believe that al-Qaeda is planning a "large-scale" attack in the USA aimed at disrupting the presidential campaign and November elections.

Homeland Security Secretary Tom Ridge said Thursday that the party conventions were among the possible targets of such an attack, although he said there had been no particular threat to either convention. Democrats meet in Boston later this month; the Republican convention begins in late August in New York City.

Ridge said the intelligence was gathered from "credible" sources, but he acknowledged that it did not yield any specific information about a possible attack.

U.S. officials have been particularly concerned about an attack during the presidential campaign since the Madrid railway bombings in March. The bombings, which killed nearly 200 people, occurred on the eve of national elections. Spain's ruling party was ousted.

Sposob ratyfikacji tej efektywnej konstytucji (no bo trzyma sie juz ponad 200 lat!) nie ma nic wspolnego z zadnym referendum ktory proponuje ten Irlandczyk. Juz ponad 200 lat temu politycy wiedzieli ze taki trudny i wazny dokument jak konstytucja jest zwyczajnie... za trudny do zrozumienia dla nie zainteresowanych obywateli. Ludzie ktorzy czerpia swoje wiadomosci z tanich szmatlawcow, interesuja sie zyciami prywatnymi gwiazd filmowych, maja wiedziec cokolwiek o polityce? Ci ludzie ktorzy czytaja te szmatlawce maja byc upowaznieni do oceniania czy konstytucja jest demokratyczna czy nie? Czy raczej tych ludzi mozna zrobic w balona za pomoca takich wlasnie populistow i pchnac ich do czynu ktorego pozniej moga zalowac?

Fakt jest taki ze gdyby konstytucja rzeczywiscie byla zagrozeniem dla demokracji to obywatele europy (przynajmniej tej zachodniej), nie czekaliby dlugo aby wyjsc na ulice i poczestowac politykow koktailami molotowa. Euro politycy wiedza ze w Europie to nie przelewka.

"Ratification
The 13 colonies in 1775

It was within the power of the old Congress to expedite or block the ratification of the new Constitution. The document that the Philadelphia Convention presented was technically only a revision of the Articles of Confederation. But the last article of the new instrument provided that when ratified by conventions in nine states, it should go into effect among the States so acting.

Then followed an arduous process of ratification of the Constitution by specially constituted conventions. The need for only nine states was a controversial decision at the time, since the Articles of Confederation could only be amended by unanimous vote of all the states. However, the new Constitution was ratified by all thirteen states, with Rhode Island signing on last in May 1790.

Three members of the Convention—Madison, Gorham, and King—were also Members of Congress. They proceeded at once to New York, where Congress was in session, to placate the expected opposition. Aware of their vanishing authority, Congress on September 28, after some debate, unanimously decided to submit the Constitution to the States for action. It made no recommendation for or against adoption.[4]

Two parties soon developed, one in opposition (Antifederalists), and one in support (Federalists), of the Constitution, and the Constitution was debated, criticized, and expounded clause by clause. Hamilton, Madison, and Jay, under the name of "Publius," wrote a series of commentaries, now known as the Federalist Papers, in support of the new instrument of government; however, the primary aim of the essays was for ratification in the state of New York, at that time a hotbed of anti-federalism. These commentaries on the Constitution, written during the struggle for ratification, have been frequently cited by the Supreme Court as an authoritative contemporary interpretation of the meaning of its provisions. The closeness and bitterness of the struggle over ratification and the conferring of additional powers on the central government can scarcely be exaggerated. In some states, ratification was effected only after a bitter struggle in the state convention itself. In every state, the federalists proved more united, and only they coordinated action between different states, as the Anti-federalists were localistic and did not attempt to reach out to other states.

Delaware, on December 7, 1787, became the first State to ratify the new Constitution, the vote being unanimous. Pennsylvania ratified on December 12, 1787, by a vote of 46 to 23 (66.67%). New Jersey ratified on December 19, 1787, and Georgia on January 2, 1788, the vote in both was unanimous.

The requirement of ratification by nine states, set by Article Seven of the Constitution, was met when New Hampshire voted to ratify, on June 21, 1788.

In New York, fully two thirds of the convention delegates were at first opposed to the Constitution. Hamilton led the Federalist campaign, including the fast-paced appearance of the Federalist Papers in New York newspapers. An attempt to attach conditions to ratification almost succeeded, but on July 26, 1788, New York ratified, with a recommendation that a bill of rights be appended. The vote was close—yeas 30 (52.6%), nays 27—due largely to Hamilton's forensic abilities and his reaching a few key compromises with moderate anti-Federalists led by Melancton Smith. Opposition to ratification was led by Governor George Clinton.

The Continental Congress—which still functioned at irregular intervals—passed a resolution on September 13, 1788, to put the new Constitution into operation."

Phoenix to Host 2009 All-Star

"Phoenix is one of the great sports and entertainment destinations, so it is only natural that it will once again become the basketball capital of the world," said Stern. "We appreciate the leadership of Jerry Colangelo, Robert Sarver and the Suns organization for inviting us to make their arena our home for what promises to be an exciting and entertaining All-Star."

The All-Star competitions will tip off on Friday, Feb. 13, as the league’s top rookies and second-year players square off in the Rookie Challenge. The excitement will continue the next day with NBA All-Star Saturday Night, which includes Shooting Stars, a competition featuring NBA and WNBA players and NBA legends, Skills Challenge, a contest of top guards working against the clock to complete a series of passes, free throws, lay-ups and agility drills, and the Three-Point Shootout, where six of the best long-range shooters compete against each other and the clock in a test of accuracy. The evening’s grand finale, the Slam Dunk Contest, will showcase some of the NBA’s best athletes as they take to the air mystifying fans with their gravity-defying creativity.

“We are proud that Phoenix, and downtown in particular, will be showcased around the world through the media’s coverage of NBA All-Star 2009,” said Suns Managing Partner Robert Sarver. “This is a great example of how our city’s leadership, public and private, can work together to bring events with major economic impact to Phoenix.”

Not all of the action will take place on the court as the NBA will celebrate its tradition and commitment to social responsibility with a schedule of NBA Cares events taking place throughout All-Star. NBA Cares will partner with schools, government and local non-profit organizations in Phoenix and surrounding areas to highlight the league’s grassroots and community initiatives that reach millions of young people and their parents while providing critical resources to community-based programs.

One of All-Star’s most popular attractions is Jam Session, the world's largest interactive basketball theme park, which will be held at the Phoenix Convention Center. In its 16th season, Jam Session will feature over 450,000 square-feet of basketball entertainment for fans of all ages - the equivalent of 48 official-size NBA basketball courts or 18 million regulation-size basketballs.

At Jam Session, fans can test their skills on over 30 unique attractions, compare their hand and shoe sizes with those of their favorite NBA players, compete against friends at on-court skills challenges, watch youngsters slam dunk and hit three-pointers at the Kids Zone, and meet some of their favorite players and legends, celebrities and musical performers. Jam Session also offers an extensive trading card and collectibles area, the NBA Store, where fans can purchase exclusive merchandise, and Center Court, the home for All-Star entertainment, where fans can watch practices, dance teams and mascots, and celebrities, NBA, WNBA players in a variety of shooting contests.

The 2009 event marks the third time Phoenix has hosted All-Star. On Jan. 15, 1975, the New York Knicks’ and future Hall of Fame guard Walt “Clyde” Frazier scorched the West with 30 points - including 10-of-17 shooting from the field - to capture MVP honors. Played at Veterans Memorial Coliseum, the Game is remembered for the performances of many eventual Hall of Famers including Rick Barry of the Golden State Warriors, John Havlicek of the Boston Celtics, and Kareem Abdul-Jabbar of the Milwaukee Bucks. Charlie Scott of the Phoenix Suns also participated in the game. In the end, the East, coached by K.C. Jones of the Washington Bullets, prevailed 108-102, against the West, led by coach Al Attles of the Warriors.

The All-Star Game returned to the desert 20 years later on Feb. 12, 1995, when Suns stars Charles Barkley and Dan Majerle were among those selected to play and Sacramento Kings guard Mitch Richmond scored 23 points in 22 minutes to earn MVP honors. Played at the then-America West Arena, Suns legend Paul Westphal coached the West to a 139-112 blowout of the East, coached by Brian Hill of the Orlando Magic. Ruiz wants random steroid testing!

The WBA's 84th annual convention is next week (October 31-November 5) in South Korea and WBA heavyweight champion John "The Quietman" Ruiz is petitioning the organization to mandate random testing for performance enhancing drugs. Reinstated as WBA champ after James Toney tested positive for violating performance enhancement drug rules after their April 30 title fight, Ruiz has publicly called for a stricter drug policy in boxing and he's frustrated that no action has been seriously discussed, never mind taken. "Nobody in boxing seems to care or they'd be tougher tests," Ruiz said. "I'm asking the WBA to rule random testing, at the very least, for all world title fights. Fighters are taking steroids and getting away with it. It's very dangerous. Steroids make fighters stronger and quicker; allow them to workout harder, longer, and comeback from injuries much quicker. It's so easy to take steroids and get away with it because we know when we'll be tested (immediately before and after fights). There's no random testing in boxing. Other sports have addressed steroid problems. Boxers risk their lives every time they go into the ring. A fighter taking steroids is going to kill an opponent someday. I only hope it doesn't take a tragedy for the WBA to make a change in its policy."

I've kept my mouth shut as it relates to responding to the continual and annoying accusations, grandstanding and somewhat disingenuous comments made by either John Ruiz or one of his mouthpieces.

However, enough is enough. Most real fighters do their talking with their fists and not their mouths...remember I said real fighters. Ruiz has done nothing but cry since being handed his WBA belt back. If he was a real man, a real fighter, he would have tried to get me back into the ring to show everyone that James Toney could not have kicked his ass if my test didn't show up positive. But he knows what I stated as the cause of my positive test was the TRUTH....prescribed medication used to reduce inflammation in my recent bicep/triceps surgery. If this wasn't the case, and he actually believed that I was using performance enhancing drugs to beat him, I can only think he would want this overblown middleweight, with the world watching his next drug test, to get back into the ring with him immediately so he could manhandle me as he said he could have done without the positive test.

Let it be said now, John Ruiz would rather go out of the country to fight, then to ever think of having to be in a ring with me again. He knows I beat him with one arm (my good one); the other arm was still recuperating from the 2004 career threatening surgery. I'm tired of hearing his continual babble and grandstanding.

The New York State Athletic Commission was given the reason why my test was positive. I believe they understood the difference of medications used for recovery purposes and those intended to enhance your performance. You didn't need to be a rocket scientist to see I was not the poster boy for steroid use.

Unfortunately, for the Commission and the WBA, their rules do not have the ability to separate the circumstances, no matter how valid they may have been.

The analogy is somewhat similar to a speeding driver who is pulled over by a policemen for going 80 mph in a 55 mph zone, but approaching the vehicle the policemen realizes the driver's wife is delivering a baby in the back seat. Now the simple act of speeding is illegal, however in this case, despite the rules and regulations of the appropriate State, the policeman now will make a determination in either giving a speeding ticket to the driver or to give him an 80 mph police escort to the hospital. The Commission didn't have the luxury in my case to make a similar determination based upon circumstances; hence the suspension.

These are the changes needed within the Commission and the WBA and anyone else the Ruiz team so designates as a future target of inadequacy.

However, like any other court of law, or system that takes into account the "possibility" of extenuating circumstances, which was the only reason I didn't fight the suspension since the rules didn't address taking prescribed medication solely for rehabilitation of my surgically repaired arm, the rules governing boxing should mirror the above referenced legal system. The Ruiz camp has taken the position of grandstanding in an area where deflection can only last so long---or at least until his next grabfest known as one of his fights.

Ruiz states, "Other sports have addressed steroid problems..." in his latest statement. Is he kidding? One of the top players in baseball received a paltry 10-day suspension for his use of steroids. Give me a break John, and go back to being the "Quiteman." Get off your high horse and fight like a man. Stop talking and whining about getting your butt kicked. I was fat, out of shape and fighting with one arm and kicked your ass---face up to it; Schwarzenegger I wasn't.

For my final and last comment on this subject, I say to the Commissions and the organizations that you've done a great job of protecting and when need be, penalizing the fighters. Keep it up.
